End-User License Agreement (EULA) — Mastward

DRAFT — not legal advice. Have a lawyer review before selling (see `Readme.md`, esp. the Australian Consumer Law note).

_Last updated: 2026-06-11 · Licensor: AXD Intelligence ("we", "us") · Software: Mastward ("the Software")_

By installing, activating a license for, or using the Software, you ("you") agree to this Agreement.

1. Licence grant

We grant you a personal, non-exclusive, non-transferable, perpetual licence to install and use the Software. A Free tier is provided at no charge with limited features. A paid licence key unlocks the Pro features and is valid for the buyer it was issued to; it does not expire unless stated on the key.

2. What you may NOT do

  • Resell, sublicense, share, or publish your licence key, or generate keys.
  • Reverse-engineer, defeat, or circumvent the licence/entitlement mechanism.
  • Remove or alter copyright, licence, or attribution notices.
  • Use the Software unlawfully, or to access systems you are not authorised to access.

  • 3. Ownership

The Software, its design, and all intellectual property remain ours. You receive a licence to use, not ownership of the Software.

    4. Your data & sovereignty

The Software is self-hosted: it runs on your machines and connects over your network. We do not host, receive, or have access to your terminal sessions, keys, or data. See `Privacy_policy.md`.

    5. Responsibility for use

The Software provides shell access and system controls (including remote actions) to your own systems. You are solely responsible for how you configure and use it, for securing your devices and tokens, and for any consequences of commands you run. Do not use it on systems you do not own or are not authorised to control.

    6. Warranties & disclaimer

To the maximum extent permitted by law, the Software is provided "AS IS" without warranties of any kind (including merchantability, fitness for a purpose, or that it is error-free or uninterrupted). Security features (e.g. secret-masking) are defense-in-depth measures, not guarantees — see `Marketing_claims.md`.

Australian Consumer Law: if you are a consumer under the Australian Consumer Law, you have guarantees that cannot be excluded. Nothing in this Agreement limits those non-excludable rights. Where permitted, our liability for breach of a non-excludable guarantee is limited to re-supplying the Software or refunding the price paid.

    7. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profit, or systems, arising from your use of the Software. Our total aggregate liability will not exceed the amount you paid for the licence.

    8. Termination

This licence terminates automatically if you breach it (e.g. sharing keys, circumventing the licence). On termination you must stop using the Pro features.

    9. Governing law

This Agreement is governed by the laws of Western Australia, Australia, and the Commonwealth of Australia.

    10. Changes

We may update this Agreement for new versions; the version you accepted governs the build you use.
